Evaluation of new legislation for compulsory forensic psychiatric treatment

Summary

This research was carried out in order to provide an insight into the manner in which the Hospital Orders Act is being implemented, and into the degree to which the legislative amendments of 1997 meet the desired alignment of the three key hospital order elements (security, treatment and legal position) in practice. The research is largely a process evaluation and is qualitative by nature.
It sets out

  1. an introduction; 

  2. the acceptance, implementation and observed bottlenecks in the Hospital Orders Act; 

  3. the legal position in relation to policy scope, treatment and security, including experiences, views and insights; 

  4. complaint; 

  5. appeal and suspension; 

  6. new elements in the Fokkens Act; and 

  7. conclusions and recommendations.
