Viability and effectiveness of conditional hospital orders for psychiatric patients

Summary

The conditional hospital order under the Psychiatric Hospitals Act [Wet bijzondere opnemingen in psychiatrische ziekenhuizen, Wet BOPZ] (a legal instrument that provides the option of treating an individual on a outpatient basis, rather than enforcing compulsory admission, providing that he or she fulfils the conditions) is to be amended as the result of a very recent judgment handed down by the Supreme Court of the Netherlands in order to widen the scope of application of this instrument.
The following questions are central to the study:
1. How do the relevant parties (judges, public prosecutors, psychiatrists) assess the usability of the proposed legislative amendment?
2. To what extent do they believe that the proposed legislative amendment will actually have the envisaged effect?
