Evaluation of the Dutch Pension Sharing in the Event of Divorce Act

Summary

The Equalisation of Pension Rights in the Event of a Divorce Act [Wet verevening pensioenrechten bij scheiding, WVPS] entered into force on 1 May 1995. The aim of the study is to examine whether current legislation in the case of divorce (in the WVPS, the Pensions and Savings Funds Act [Pensioen- en Spaarfondsenwet, PSW] and the Dutch Civil Code) is still effective. This relates to a commitment made by Parliament (Proceedings II, 5 April 2005, p. 68-4301, confirmed in a letter from the Minister of Social Affairs and Employment to the Lower House dated 30 June 2005). The statutory regulations were established before the surviving dependant’s pension under pension schemes was converted on a large scale from ‘accrual basis’ to ‘risk basis’.
